Procedure for the execution of judgment by writ or fierifacias is the process to enforce a debtor by judgment to conductpecuniary performance according to the judgment or court order.Such procedural law and its process must be fair and lucid toensure justice for all parties concern. This study uncovered the undesirable fact that theprocedure for the execution of judgment by writ of fieri faciasaccording to the provisions of the Civil Procedure Code ofThailand lacks necessary legal provision to facilitate theprocess of seizing property of a debtor by judgment for the onlyamount sufficient to cover the judgment debt. Unfairness therebyresulted from excessive seizing of debtor and third person'sproperty. At the same time, such procedure does not give anyadequate assistance and protection to the judgment creditor forthe whole performance of debt according to the judgment or courtorder. The author analyzed the aforesaid problems and recommendsthe suitable amendments to the Civil Procedure Code.
