In Rice Engineering Supply Co. Ltd. v. Boonrearng Srisawat, the Intellectual Property and International Trade Court (IP&IT Court) ruled on November 10, 2003, that Rice had no rights to any intellectual property rights (IPR) arising from research funded by a three-party research project. The research project was originally supported by the Thailand Research Fund (TRF) and King Mongkut’s University of Technology Thonburi (KMUTT). Rice later joined to fund the project. Because of an unclear university intellectual property policy and limited experiences in IPR management by the university, Boonrearng, a graduate student at KMUTT, filed a patent on certain research results under his own name. IPR management at university is currently a big challenge in Thailand. Concerns include a student’s duty to assign the ownership of his or her IPR to the university, a student’s employee status under a university research project, and conflict of interest between a private grantor and a research contractor.
